What is probate?
Probate is a court process that resolves a person’s estate after their death—and results in the transfer of the decedent’s property to his or her heirs – either as provided by the decedent’s Will or as provided by state law if there is no Will.
If the assets of the decedent’s estate are in order, and there are no contested issues, the Florida probate process can be relatively simple.
However, there are times when probate becomes more complicated. Perhaps the estate is left in confusion or assets are lost or hidden. Perhaps there is a dispute over the validity of the Will or the ownership of certain property. These complications will extend the probate process and increase the expense.
